1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern the provision of services by NQB Security (“we”, “us” or “our”) to any individual or business engaging our services (“you” or “client”), as well as your use of our website.

By accepting a quote, engaging our services, entering into a service agreement with us or using our website, you agree to these Terms.

Where a separate written agreement, accepted quote or contract exists between you and NQB Security, the terms of that document will apply to the extent of any inconsistency with these Terms.

2. Our Services

NQB Security provides security and communications solutions for residential, commercial and other properties.

Our services may include:

  • CCTV and security camera installation;
  • alarm system installation;
  • access control systems;
  • intercom systems;
  • security and communications equipment;
  • system configuration and setup;
  • security system repairs and fault finding;
  • servicing, maintenance and upgrades;
  • technical support;
  • optional monitoring solutions where agreed; and
  • advice relating to the selection and placement of security equipment.

The specific products and services provided will be described in your quote, invoice, service agreement or other written scope of work.

NQB Security may decline or discontinue work where we reasonably believe the requested work is unsafe, unlawful, technically unsuitable or outside the scope of our services or capabilities.

3. Quotes and Scope of Work

Quotes provided by NQB Security are based on the information reasonably available to us at the time.

Unless otherwise stated on the quote, a quote is valid for 30 days from its issue date.

A quote may need to be revised where:

  • the requested scope changes;
  • additional equipment or labour is required;
  • previously unknown faults or site conditions are identified;
  • access to the required installation area is more difficult than reasonably anticipated;
  • existing cabling, equipment, power or network infrastructure is unsuitable;
  • additional work is requested by the client; or
  • supplier pricing or product availability changes before the quote is accepted.

We will seek your approval before proceeding with material additional work that is outside the agreed scope, except where immediate action is reasonably necessary to make an installation or site safe.

4. Installation and Servicing

NQB Security will perform installation, servicing and maintenance work with reasonable care and skill.

The performance of security equipment may depend on factors outside our control, including:

  • internet and network availability;
  • mobile network coverage;
  • electricity supply;
  • third-party cloud services;
  • manufacturer platforms and applications;
  • compatibility with existing equipment;
  • environmental conditions; and
  • changes made to equipment or settings by the client or another service provider.

We cannot guarantee uninterrupted operation of equipment or third-party services that are outside our reasonable control.

5. Client Responsibilities

You agree to:

  • provide safe and reasonable access to the property at the agreed appointment time;
  • provide accurate information about the property and existing security equipment;
  • inform us of known hazards or access restrictions before work begins;
  • ensure you have authority to approve work at the property;
  • provide access to electricity, internet, network infrastructure or other services where reasonably required;
  • obtain any approvals, permissions or consents required from a property owner, body corporate, landlord or other relevant party;
  • follow reasonable operating and maintenance instructions provided with installed equipment; and
  • promptly notify us if you become aware of a fault that may affect the safe or proper operation of equipment we have installed or serviced.

You are responsible for ensuring that CCTV cameras, recording equipment, access control systems and other surveillance equipment installed at your request are operated lawfully.

This includes obtaining any notices, permissions or consents required under applicable privacy, surveillance, workplace or other laws.

6. Existing Equipment and Infrastructure

Where NQB Security is asked to repair, service, upgrade or integrate with existing equipment, we cannot guarantee the condition, compatibility or remaining lifespan of equipment that we did not originally supply or install.

Existing cabling, networks, power supplies, cameras, alarm components, access control hardware and other infrastructure may require additional work or replacement if they are found to be faulty, unsafe or incompatible.

We will advise you where reasonably practicable if additional work is required.

7. Equipment and Product Availability

Security equipment may be subject to supplier availability.

Where an item specified in a quote becomes unavailable, discontinued or subject to unreasonable delays, NQB Security may recommend a reasonably comparable alternative.

Any material difference in functionality or price will be discussed with you before substitution.

Product specifications, applications and cloud-based features may also be changed by manufacturers from time to time. NQB Security is not responsible for changes made by a manufacturer or third-party platform after installation.

8. Fees and Payment

Fees will be set out in the relevant quote, invoice or service agreement.

Payment terms will be stated on your invoice or quote.

Depending on the nature and value of the work, NQB Security may require a deposit, progress payment or payment for equipment before installation.

Unless otherwise stated, prices are exclusive of GST, with GST added where applicable.

You agree to pay approved additional costs where work outside the original scope has been requested or authorised.

If an invoice becomes overdue, NQB Security may suspend further work, support or ongoing services until outstanding amounts are paid, subject to applicable law and any existing agreement.

9. Cancellations and Rescheduling

If you need to cancel or reschedule an installation or service appointment, please provide reasonable notice.

Where equipment has been specially ordered, configured or obtained specifically for your project, cancellation may be subject to supplier charges or other costs already reasonably incurred by NQB Security.

Any applicable cancellation, restocking or call-out charges will be communicated where relevant.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

10. Monitoring Services

Where monitoring is included in the agreed scope of services, the specific monitoring arrangements, inclusions, fees and responsibilities will be set out in the relevant quote, agreement or monitoring service documentation.

You acknowledge that monitoring services may depend on telecommunications networks, internet connectivity, power supply, third-party monitoring platforms and other infrastructure outside NQB Security’s reasonable control.

Security and monitoring systems are intended to assist with detecting or responding to security events. They cannot guarantee that burglary, theft, property damage, unauthorised access or other incidents will not occur.

NQB Security is not an insurer of your property, belongings or business.

Where monitoring is provided by a third-party monitoring provider, that service may also be subject to the provider’s own terms and conditions.

11. CCTV and Recorded Footage

Where NQB Security installs or services a CCTV system, you remain responsible for the operation of the system and any footage recorded by it unless a separate written agreement states otherwise.

You are responsible for determining:

  • where cameras are operated;
  • who is authorised to access recordings;
  • how long recordings are retained;
  • whether signage or notices are required; and
  • whether the use of the system complies with applicable privacy, surveillance and workplace laws.

NQB Security may temporarily access system settings, footage, recordings or logs where reasonably necessary to install, configure, test, diagnose or repair a system.

We will only access such information where reasonably required to perform the requested service.

12. Third-Party Applications and Cloud Services

Some security products rely on applications, cloud storage, remote-access platforms, telecommunications services or other technology operated by third parties.

These services are outside NQB Security’s direct control and may be subject to separate terms, subscriptions and privacy policies.

NQB Security is not responsible for an outage, feature change, discontinuation, account restriction or other failure caused by a third-party platform or service provider, except to the extent that liability cannot lawfully be excluded.

Clients are responsible for maintaining their own usernames, passwords and account credentials for third-party platforms unless otherwise agreed.

13. Warranties

Products supplied by NQB Security may be covered by manufacturer warranties.

The duration and conditions of those warranties vary depending on the manufacturer and product.

Where applicable, NQB Security will reasonably assist clients with legitimate warranty claims relating to products we have supplied.

A warranty may not cover damage or faults caused by circumstances such as misuse, physical damage, unauthorised modification, power issues, network problems, environmental conditions or work performed by another person.

Nothing in these Terms excludes or limits any guarantee, warranty or right that cannot lawfully be excluded under the Australian Consumer Law.

14. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy available to you under the Competition and Consumer Act 2010 (Cth) or other applicable legislation where doing so would be unlawful.

15. Liability

To the maximum extent permitted by law, NQB Security is not liable for indirect or consequential loss arising from circumstances outside our reasonable control, including outages or failures of internet services, telecommunications networks, electricity supply, third-party applications, cloud platforms or manufacturer services.

Security systems are designed to assist with security and monitoring. No CCTV, alarm, access control, intercom or monitoring system can guarantee that a security incident, theft, damage, unauthorised access or other loss will not occur.

Any limitation or exclusion of liability in these Terms applies only to the extent permitted by law.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

16. Insurance

NQB Security maintains insurance appropriate to its business operations.

Clients remain responsible for maintaining appropriate insurance for their home, business, property, equipment, contents and other relevant risks.

Installation of a security system does not replace the need for appropriate insurance.

17. Confidentiality and Security Information

During installation or servicing, either party may obtain confidential information about the other.

For NQB Security, this may include information about your:

  • security system configuration;
  • camera locations;
  • alarm equipment;
  • access control arrangements;
  • property access;
  • network configuration; or
  • other security-related information.

We will take reasonable steps to keep confidential information secure and will use it only where reasonably required to provide our services, manage our business or comply with legal obligations.

You must also keep confidential any sensitive technical or business information belonging to NQB Security that is provided to you and identified as confidential.

18. Ownership of Equipment

Unless otherwise agreed in writing, equipment supplied by NQB Security remains our property until the applicable invoice for that equipment has been paid in full.

Once payment has been received in full, ownership of purchased equipment passes to you, subject to any applicable third-party software, licensing or subscription conditions.

Any equipment provided under a rental, subscription, monitoring or other arrangement remains subject to the ownership terms specified in the applicable agreement.

19. Intellectual Property

NQB Security retains ownership of its own documents, designs, templates, drawings, reports and other intellectual property created in connection with its business.

Where materials are prepared specifically for your security system, you may use those materials for the operation, maintenance and management of that system.

Third-party software, applications, documentation and other materials remain subject to the intellectual property rights and licence terms of their respective owners.

20. Website Use

The NQB Security website is provided for general information about our business and services.

You must not use the website unlawfully, interfere with its operation, attempt to gain unauthorised access to our systems or reproduce website content without permission except where permitted by law.

Information on the website is general in nature and should not be treated as a specific security assessment, quotation or recommendation for a particular property.

While we aim to keep website information accurate and current, information may change without notice.

21. Privacy

Personal information collected by NQB Security is handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and disclose personal information in connection with enquiries, quotes, installations, servicing, maintenance, monitoring and our website.

22. Force Majeure

NQB Security will not be responsible for a failure or delay in performing an obligation where that failure or delay is caused by circumstances reasonably outside our control.

These circumstances may include severe weather, natural disasters, power failures, telecommunications outages, supplier disruptions, industrial action, government restrictions or other significant events that prevent us from reasonably providing the service.

23. Dispute Resolution

If a dispute arises regarding our products or services, you agree to contact NQB Security first and provide us with a reasonable opportunity to investigate and attempt to resolve the matter.

Both parties agree to make reasonable efforts to resolve disputes through good-faith discussion before commencing formal legal proceedings, except where urgent legal action is reasonably necessary.

Nothing in this section limits any rights or remedies available under applicable consumer protection laws.

24. Governing Law

These Terms are governed by the laws of Queensland, Australia.

You and NQB Security submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

25. Changes to These Terms

NQB Security may update these Terms from time to time to reflect changes to our services, business practices or legal obligations.

The latest version will be published on our website with its effective date.

Where you have an existing signed agreement with NQB Security, changes to these website Terms will not override the terms of that agreement unless agreed between the parties or otherwise permitted by law.
